All permitting for new drilling, fresh water usage and licensing of disposal wells falls under the jurisdiction of the Texas Railroad Commission. (RRC). RRC Chairman Victor Carrillo said in a statement, "This technology holds the promise of addressing two issues in the rapidly developing Barnett Shale area, the use of fresh water to fracture gas formations and the disposal of this waste water after a formation is fractured. If this technology works the way we believe it will, it will offer tremendous benefits by allowing up to 85 percent less fresh water to be used at each frac job. This process also would help reduce the amount of wastewater that must be disposed to injection wells." RRC Commissioner Michael Williams said in the same statement, "The Commission strives to maximize oil and gas production in Texas while maintaining a high level of environmental responsibility. With more than 25 trillion cubic feet of recoverable natural gas, the Barnett Shale offers a tremendous opportunity in both areas. This recycling technology will allow operators to conserve fresh water and protect the environment in the development of the top producing field in Texas and the third largest producing field in the nation." Fountain Quail will charge a processing fee for each barrel of water processed. Each mobile evaporator unit is capable of processing 2300 barrels/day of contaminated water and returning approx. 2000 barrels/day as fresh water.
